On Copyright…

January 11, 2007 by Marcus Grimm

From time to time publishers ask us about the legal ramifications of producing digital editions of their print product, in regards to copyright permissions they have from freelance authors and/or photographers.

In a recent court ruling, the courts held when publishers are creating digital editions with the same content, style and a similar layout to the original publication, the material is covered as a “privileged revision.”
What this essentially means is that the only publishers who need to be concerned about the digital rights of work produced by freelancers is in cases where they are repurposing the material in a new style and layout in a digital-only form when they haven’t secured rights for such material.

That being said, contrary to what I may have told my Mom, I’m no lawyer and you should probably interpret the decision yourself here.
